The sum of human history and technological advancement led to a point Wednesday where the sound of a flushing toilet could be heard while the highest court in America was listening to oral arguments remotely given the COVID-19 pandemic.

An awkward moment when a toilet llushes during Supreme Court oral arguments.

The federal courts have long resisted live electronic transmissions of their proceedings and now we have liquid evidence in support of same.

Given the COVID-19 pandemic and the advanced age vulnerability of many of the members of the United State Supreme Court, the Supreme Court has been forced to conduct oral arguments remotely while working at home.

In turn, it was only to be expected that there would be a hot mike moment.

Needless to say, Roman Martinez, the attorney speaking when the flush was heard, will surely be suffering considerable ribbing even if it is unlikely that the was the culprit.

No idea, however, who was the flusher – although given the advanced age of many of the male members of the court, they are on the short list.

In any event, there is something to be said for the timing of the flush as Attorney Martinez was arguing that the Telephone Consumer Protection Act of 1991’s robocall ban is “an unconstitutional content-based restriction of speech.”
